Constitution

1 . NAME

The organisation shall be known as ‘THE JUDO FEDERATION OF INDIA” and/or “Bharatiya Judo Mahasangh” (hereinafter called the “Federation” or “JFI”).

2 . ADDRESS

The office of the Federation shall be located at the address of the General Secretary and/or at a place decided by the General Body.

3 . JURISDICTIONS

The territory under the jurisdiction of the Federation shall be the Union of India.

4 . DEFINITIONS AND EXPLANATIONS

(a) `Constitution’ means the Constitution of the Judo Federation of India.

(b) `Member’ or `Member Unit’ means member of the Judo Federation of India.

(c) The `Executive Committee’ or `EC’ means the Executive Committee of Judo Federation of India.

(d) The `Technical Council’ or `TC’ means the Technical Council of the Judo Federation of India.

(e) The `General Body’ or `G.B’ means the General Body of the Judo Federation of India.

(f) The `Judoka’ means any person who actively plays/teaches and/or promotes the Art and sports of Judo.

5 . OFFICIAL  YEAR

The financial year of the Federation shall be from 1st April to 31st March of every year.

6 . OBJECTS

(a) To encourage the Art and Sport of Judo and/or allied Arts and Sports and to provide leadership and guidance for the same in the Union of India.

(b) To promote, regulate and control the Art and Sport of Judo and/or allied Arts and Sports in India in accordance with the Constitution and the Bye-laws of the Federation.

(c) To provide, foster and maintain relations with and between national and international organisations, federations, associations and/or institutions concerned with objects similar to those maintained herein.

(d) To foster and maintain a spirit of competition among its members on a high plane of sportsmanship and friendly endeavor and in this connection to recognize or patronise, acquire or provide facilities of all kinds, monetary or material, to all or any of the members.

(e) To affiliate, recognize and/or patronize associations, organisations, and/or institutions actively indulging in Judo and/or allied Arts and Sports provided they meet with the requirements of the Constitution and/or Bye-laws of the Federation.

(f) To hold and/or supervise and/or arrange to hold and supervise competitions, training, coaching camps and/or sports events, etc., of any sort.

(g) To participate in the international Sports events.

(h) To award grades and promotions and to conduct or arrange for gradation examinations to be held.

(i) To hold and/or arrange coaching camps and examinations for the courses of Instructors, Referees and Judges, etc.

(j) To elect a `Technical Council’ of the Federation for the purpose of forming and/or canceling, as and when it deems fit, Rules and Regulations of Competition, the system of teaching, practicing and examining in the Art and Sport of Judo and/or allied Arts and Sports.

(k) To publish and/or arrange to publish books, periodicals, literature, pamphlets and all other kinds of printed or cyclostyled matter relating to Judo and/or allied Arts and Sports.

(l) To affiliate itself with National and International organisations but only to the extent to which this Federation remains free and independent to follow its own Constitution and Bye-laws.

7 . MEMBERSHIP

a) The membership of the Federation shall be open to those who advocate the Art and Sport of Judo and or allied Arts and Sports and fulfill the object and other requirements of the Constitution and Bye-laws of the Federation.

(b) Any association or organisation or institution which has been granted affiliation by the Federation shall be called `Member’ and/or `Member Unit’ of the Federation.

(c) The members will be of following categories :

(i) Patrons : Any eminent person may be appointed as patron of the Federation by the Executive Committee. Such persons will be patron members and will have no voting rights. No fee is payable by a patron. When a patron attends any activity of the Federation he will be accorded the same status, perks and facility as accorded to the President of the Federation.

(ii) Life Members : Any person who pays a lump sum donation, in cash or kind, exceeding Rs. 25,000/- or as may be decided by the Executive Committee from time to time will be life Member of the Federation. The life Member will have No voting right. The Life Member and/or his representative is eligible to participate in all activities of the Federation and will be accorded the same status, perks and facility as accorded to the office-bearers of the Federation.

(iii) Associate Members : Organisations or institutions other than state associations or departmental Units will be Associate Members. An Associate Member will be entitled to only one vote and that also only on a resolution passed by the General body to that effect. The fees payable by an Association Member is Rs. 5000/- Entrance fee and Rs.7000/-annual fee or as decided by the Executive Committee from time to time.

(iv) Ordinary Members : State Associations and Departmental Units [other than organisations or institutions] who actively promote the Art and Sports of judo in their State or area will be `Members’ of the Federation. Such Members will be entitled to two votes each. The fee payable by a Member is Rs.5000/-entrance fee and Rs.4000/-annual fee or as decided by the Executive committee from time to time.

8 . MANAGEMENT

(a) The General Body shall consist of not more than two accredited representatives from each ordinary member and not more than one accredited representative from each associate member. The Life Members and Executive Committee Members can also be present at the General body Meeting but they shall Not have right to vote unless they are accredited representative of members having voting rights.

(b) 1. The Members of the Federation’s Executive Committee shall be:(A) One :President (B) A Maximum of Five vice Presidents (C) One General Secretary, (D) a Maximum of Seven Joint Secretaries (E) The Treasurer (F) Chairman, Vice-Chairman, and Secretary of Technical council; will be Ex-office Members and (G) a maximum of Five Associate Vice Presidents.

    2. Other than those above, a maximum of nine (9) persons may be elected from amongst those present and voting, as members of the Executive Committees.

    3. Other than those elected, the President may be empowered by the General Body to nominate three eminent persons as Associate Vice Presidents of the Federation. Such person need not be accredited representatives of the members.

    4. The President may also be empowered by General Body to appoint a maximum of four Zonal Secretaries to assist the General Secretary. The Zonal Secretaries need not be from amongst those present but can also be persons who are actively associated with the activities of the Federation and/or its members.

(c) The office bearers of the Federation shall be the President, the General Secretary and the Treasurer.

(d) 1. The election of the office-bearers and members of the Executive Committee shall be conducted atleast once every four years.

    2. If any member of the Executive Committee including the President resigns and/or ceases to be members of the Executive Committee for any reason whatsoever, the other members of the Executive Committee will by a majority vote, appoint another person from amongst themselves for the remaining period of his tenure. Such appointment is to be confirmed by the very next General Body Meeting to effective thereafter.

   3. The Age and Tenure clause of Ministry of Youth Affairs & Sports, Govt. of India for the Officer bearers of JFI, as stipulated in the Govt. Guidelines ( circular letter dated 1st May 2010 ) will be applicable for future elections of JFI.

(e) A meeting of the General Body will be held atleast once within six months of the end of the financial year of the Federation. The quorum at General Body Meeting shall be one third (1/3) of the members of the Federation. A notice of twenty one (21) clear days shall be given to call a meeting of the General Body.

(f) The Executive Committee will hold its meetings at least one time during a year. The quorum at such meetings shall be 7 members of the Executive committee.

(g) One third of the members of the Federation may jointly requisition a General Body Meeting by sending a notice in writing to the General Secretary. Such notice must reach him not later than forty (40) days before the date of the intended meeting. The notice must state clearly the purpose for which the meeting is called. The General secretary will call the said meeting within but not later than (10)days of the receipt of the notice of requisition by him. He will issue a twenty one (21) days notice of the said meeting as in the normal course and such notice will clearly specify the purpose for which the meeting is called.

(h) In an emergency, the President or the General Secretary acting on the authority of the President, shall have the power to call an emergency meeting of the Executive Committee and/or the General body by giving seven (7) days notice, such notice can be by Letter, Phone, fax, Telex and/or Telegraph to the members.

9 . THE TECHNICAL COUNCIL-POWERS AND DUTIES

(a) The Technical Council (hereinafter called the `council) shall consist of not more than nine (9) members at any time.

(b) Members of the Council shall be only Black Belts of the Federation.

(c) The elections of the Chairman, Vice - Chairman and Secretary will be held along with the election of the Federation’s Executive committee. The rest will be nominated by the President/ Executive Committee.

(d) The Council is empowered to make, amend and/or cancel all technical rules and regulations of Judo and/or allied Arts and Sports, such rules and regulations will be subject to the approval by Executive Committee.

(e) The President and General Secretary of the federation shall be ex-officio members of the council and similarly the Chairman, Vice-Chairman and Secretary of the Council shall also be ex-officio members of the Executive committee.

(f) The quorum at meetings of the Council shall be one third (1/3) of its total members.

(g) All business at meetings of the Council shall be decided by a majority vote, voting will be by show of hands.

(h) The council shall maintain proper records of its meetings and proceedings. The records will be placed before the Executive committee as and when required by them. (i) A meeting of the council shall be held at least one time in a year. A notice of fifteen (15) days will be issued in writing to all members for this purpose.

10 . ELECTIONS

(a) The election will be held once every four (4 ) years. The elections will be by show of hand or if demanded by two or more members, by secret ballot. In case of secret ballot, none of the candidates will be the President/Returning Officer at the elections. The General Body will elect one person as president or returning officer to conduct the election from amongst the remaining persons present at the meeting.

(b) Only an accredited representative of a member can vote at the elections, similarly, only accredited representative can contest the elections of the Federation.

(c) Voting cannot be by proxy, the physical presence of the accredited representative of Member is compulsory to cast the vote. Similar, to contest the elections the physical presence at the venue of elections of the accredited representative contesting the Elections is also compulsory.

(d) Each accredited representative present can cast only one vote.

(e) The result of the election will be by simple majority.

11. .THE GENERAL BODY : POWERS AND DUTIES

(a) To adopt and approve the audited accounts of the Federation.

(b) To appoint auditors.

(c) To hold elections of office bearers and other members of the Executive Committee.

(d) To decide the overall policy of management, administration and finance of the Federation, to supervise the Executive committee’s functions.

(e) To ensure that the Constitution rules and regulations and bye-laws of the Federation have been executed and implemented correctly and in their true spirit by the `members’ of the Federation and the Executive committee.

(f) To ratify the minutes of the Executive committee.

(g) To give voting rights to an associate Member.

(h) To appoint committee and/or Sub Committee as and when required.

(i) To enforce all Rules and Regulations of the International Judo Federation.

(j) To enforce and defend the exclusive right to use the International Judo Federation/Indian Olympic Association Flag and Insignia and Logos, etc.

(k) To be the Official organisation in complete and absolute charge of all Judo and/or allied Arts & Sports matters within India.

(l) Generally to have complete and absolute jurisdiction over all matters and programs pertaining to Judo especially related to Asian and International competitions, participation by Indian Judokas in all tournament, World Championships and Asian, Commonwealth and Olympic games and other events irrespective of their name and/or title.

(m) To inspect the annual activities and financial reports of the members and act on the same.

(n) To frame rules and regulations and Bye-laws of the Federation.

(o) To take disciplinary action against any member of the Federation and/or a person associated with a members of the Federation for any violation of the Constitution, Rules and Regulations and bye-laws of the Federation.

(p) To delegate its power to any Committees, office bearers and/or member of the Federation.

12 . THE EXECUTIVE COMMITTEE : POWERS AND DUTIES

(a) To implement and interpret the Constitution, Rules and Regulations and Bye-laws and to see that they are followed by the members of the Federation.

(b) To interpret and decide matters not specifically provided for in the Constitution such as rules and regulations and/or Bye-laws of the Federation.

(c) To admit to membership at its discretion any association, organisation and/or institution, eligible for membership.

(d) To form Bye-laws for the purpose of administration as and when required.

(e) To appoint sub-committees and members of Technical Council.

(f) To call meetings regularly.

(g) To take action, suspend and/or withdraw membership of any member and/or person for indiscipline, undesirable activities and/or violation of the Constitution of the Federation.

(h) To appoint ad-hoc Committee when the member, has for all practical purposes ceased to function effectively. The ad-hoc Committee will function till such time as, a new Body approved by the Federation is formed in that State.

(i) To decide and interpret the provisions of the Constitution when disputed.

(j) To invest money belonging to the Federation.

(k) To receive and distribute in the most appropriate manner subscriptions, gifts, donations and funds bequeathed or in any way entrusted to the Federation for any and/or all objects of the Federation as elaborated in para 15 and/or for the like purpose to collect and obtain money by subscription, gift, donation and/or any other lawful means.

(l) To borrow any money that may be required for very important purpose of the Federation by mortgage or charge on the securities and/or fixed assets as may be determined from time to time provided that the amount of such borrowings shall not at any time be secured by mortgage or charge on properties or assets of the Federation exceeding at any time one half of the net value of all the properties and funds of the Federation.

(m) To purchase, take on lease or in exchange, hire or otherwise acquire any movable or immovable properties or any rights or privileges necessary or convenient for any of the purposes of the Federation.

(n) To construct or alter or keep in repair any or all of the properties and assets owned or used by or for the objects of the Federation.

(o) To use the money of the Federation, not immediately required, for the purchase or construction of any land or building on lease or otherwise and/or to invest such surplus in Bonds, shares, debentures of any limited company registered in India or in fixed or cumulative deposit accounts with any nationalised or reputed Bank in India.

(p) To maintain correct accounts of the Federation and to recommend appointment of auditors to the General body.

(q) To perform such other duties as are incidental or related to the Aims and Objects mentioned in the Constitution and Bye-laws of the Federation.

13 . FEES AND REPRESENTATION

(a) The affiliation fees payable by the members of the Federation shall be decided by the Executive Committee from time to time. Such fees shall be payable within One hundred and thirty (130) days from the commencement of a financial year.

(b) The representatives of a member unit whose fees are in arrears by more than One hundred and Ninety (190) days from the commencement of a financial year shall not thereafter be entitled to attend and vote at any meeting of the Federation or participate in any activity of the Federation until the arrears are cleared and a receipt issued therefore.

(c) Those members who do not pay their fees within six calendar months from the commencement of a financial year may on a decision of the Executive Committee be suspended and/or cease to be members of the Federation.

(d) Those who cease to be members under the paragraph 13 (b) above may be re-admitted by the Executive Committee and/or the General Body by paying a minimum fine of Rs.50/- per month for the months of default and/or a larger amount of fine as decided by the Executive Committee from time to time.

14 . POWERS AND DUTIES OF OFFICE BEARERS

(a) THE PRESIDENT :

(i) He shall be the Chief Officer of the Federation. He is empowered to call meetings of the Federation’s Executive Committee, General body, the council or any other sub-committee of the Federation.

(ii) He will preside over all meetings of the Federation’s Executive Committee and/or General Body. He will guide the members thereof and supervise the work of the Executive Committee and/or sub-committees, in all matters.

(iii) He will keep in touch with the work of the General Secretary, the Treasurer and others and guide them on important matters pertaining to the work of the Federation.

(iv) He is empowered to delegate his powers to the Vice Presidents and in the confirmed absence of the General Secretary and/or Treasurer, he is empowered to delegate their duties to another member of the Executive Committee.

(v) To ensure that the financial position of the JFI is sound and no unauthorized expenditure is incurred. The President of JFI is authorize to sanction expenditure up to Rs.5,00,000/- ( Rupees Five Lacs only )

(b) VICE PRESIDENTS :

In the confirmed absence of the President or under the President’s (written) instruction, one of the Vice Presidents may act for the President in his absence.

(c) THE GENERAL SECRETARY :

(i) He shall be the Executive Officer of the Federation. He will look after the day to day work and welfare of the Federation and manage the same in consultation with the President and co-operation with the Treasurer and other Executive Committee members in accordance with the Constitution and Bye-laws of the Federation. He will give effect to all the resolutions of the General Body and Executive Committee.

(ii) To carry on correspondence on behalf of the Federation and to keep the President informed about the same.

(iii) To ensure the safety of all movable and immovable properties of the Federation and to keep the minute book written and upto date and maintain other records of the Federation.

(iv) To be responsible to the Executive Committee and the President and to carry out their directions.

(v) To call the meetings of the Executive Committee and/or General Body at a time and place decided in consultation with and/or under the (written) direction of the President.

(vi) To keep in touch with the work of the Council and to place their decisions for consideration before the Executive Committee.

(vii) The General Secretary, JFI is authorized to sanction expenditure upto Rs.1,00,000/- One Lac only ) . To obtain the sanction of the President on all matters pertaining to expenditure and withdrawals from the Bank of a sum exceeding Rs.1,00,000/-.

(viii) With the consent of the Executive Committee to delegate to the Joint Secretaries or other officer bearers any of his duties.

(ix) To be one of the signatories along with the President and the Treasurer in operating the Bank accounts and/or in the purchase/sale of any assets or investments and/or in agreements of any nature on behalf of the Federation.

(x) In the absence of the Treasurer to act for him and to assume his responsibilities.

(xi) To retain with him, if necessary, cash/imprest or an amount not at any time exceeding the sum of Rupees ten thousand (Rs.10,000/-) or as decided by the Executive Committee from time to time.

(xii) To carry out diligently all other duties that may be entrusted to him by the Executive Committee and/or President.

(d) THE JOINT SECRETARY :

The Joint Secretary shall assist the General Secretary and shall carry out the work assigned by him.

(e) TREASURER :

(i) To see that the accounts of the Federation are maintained properly in consultation with the President and co-operation with the General Secretary.

(ii) To check and verify all payments made on behalf of the Federation.

(iii) To see that all the money, subscriptions and government grants are collected and deposited in the Federation’s Bank account.

(iv) To bring immediately to the attention of the President and/or the Executive Committee any of the Federation’s financial affairs which do not satisfy him.

(v) To get the accounts of the Federation written up and audited by the Auditors and to place the audited final accounts before the Executive Committee and the General Body for adoption.

(vi) To carry out all other duties that may be entrusted to him by the Executive Committee and/or the President.

(vii) To be one of the signatories alongwith the President and General Secretary in operating the Bank Accounts and/or in purchase/sale of any assets or investments and/or agreements of any nature on behalf of the Federation.

15 . AUDIT AND ACCOUNTS

The General Body meeting shall appoint the auditor(s) who shall hold office for one financial year at a time. The final accounts along with the auditor’s Report shall be placed before the general body Meeting for the purpose of information and if thought fit, adoption by the members.

16 . FUNDS OF THE FEDERATION

(a) The income and property of the Federation from whatever source derived shall be applied for and towards the promotion of the objects of the Federation as set forth in this constitution. Provided, however, that when any donor of subscription or gifts or bequests or a member of a Federation earmarks any donation, subscription, gift or bequest for a particular purpose, then in such case the earmarked donation, subscription gift or bequest and the income and profits arising there from shall be applied for and towards such specified purpose only.

(b) No portion of the income, accumulated income, property or the assets of the Federation shall be paid or transferred directly or indirectly by way of dividend, bonus or otherwise by way of distribution of profits to persons who may be or have been at any time members of the Federation or to any of them or to any person claiming through them, provided that nothing herein contained shall prevent :

  1. The payment in good faith of remuneration to any office bearer, officer(s) or servant(s) of the Federation or to any member(s) thereof or other person(s) in return for any services rendered by such person(s) to the Federation, and/or expenses incurred by and/or through them on behalf of the Federation. 
  2. The distribution of surplus assets of the Federation as stated in the dissolution clause following.

(c) If, upon the dissolution of the Federation there shall remain, after the satisfaction of all its liabilities, any surplus assets the same shall be distributed after liquidation or otherwise among the members of the Federation on equitable basis. The mode of distribution shall be determined by a three fourth (3/4) majority of the members present in person at an Extraordinary General Meeting called for the specific purpose of dissolution or in default thereof by refereeing the matter to reputed Arbitrator(s) or if no arbitrator(s) can be agreed upon, then as decided by a competent court.

17 . DISCIPLINARY REGULATIONS

(a) Violation of the constitution, Rules and Regulations and of the Bye-laws of the Federation on grounds of ignorance of the same will not be accepted as an excuse by the General Body/Executive Committee.

(b) A member or person who violates the constitution, Rules and Regulations and/or Bye-laws of the Federation and or a member unit or person who aids and abets such a violation shall be dealt in similar manner by the General Body/Executive Committee.

(c) Action against such a member/person may result in fine and/or suspension and/or withdrawal of membership or as is decided by the General Body from time to time.

18 . DISPUTES AND SETTLEMENTS OF DISPUTES

(a) In case of a dispute by a member with the Federation and/or between two members and/or within a member, the party or parties to the dispute shall refer the matter in writing to the Federation for arbitration.

(b) No dispute will be referred to a court of Law by any member and/or representative of a member and/or an association, organisation or institution or their member and/or representative and/or a person seeking membership of the Federation before submitting such dispute in writing to the Federation for arbitration.

(c) The Executive Committee on receipt of such a dispute and on the advice of the President will appoint an arbitrator or a maximum of three (3) arbitrators, at their next meeting. The arbitrators so appointed will, call for the documents and parties concerned, hear them, if necessary more than once, and submit their award in writing within six months from the date of the first hearing to the Executive Committee. The award of the arbitrators shall be binding on all parties concerned.

(d) It is the responsibility of the parties to the dispute to appear before and cooperate with the arbitrators appointed to settle the dispute.

(e) In case a party to the dispute is dissatisfied with the award by the arbitrators, he/they may seek legal remedy in a Court of Law thereafter. Any violation of Clause 18(a), 18(b) will mean:

  1. in case of a member, an automatic suspension and/or cancellation of the membership.
  2. in case of a person or persons temporary or permanent suspension from participating in any of the activities and programs of the Federation.

19 . DISQUALIFICATION

The following are not eligible to be sent as representatives of the members. Such person even if elected shall forthwith cease to hold due office/post they are elected/appointed to by the Federation.

(a) A person who has been adjudged by a competent court to be of unsound mind or is deaf and mute or is suffering from leprosy or any infectious diseases.

(b) A person who is an declared an insolvent by Court of Law.

(c) A person who has been convicted for any offense, involving moral turpitude.

(d) A person who is ineligible under any Rules and/or Bye-laws of the Federation.

(e) Any employee of the Federation or any other equivalent body.

20 . POWER TO FORM BYE-LAWS

The Executive Committee shall have the power to make, change or repeal Bye-laws which should be consistent with the Constitution. Such Bye-laws as are declared by the Executive Committee shall be binding on all the members of the Federation. Any such Bye-laws made, changed or repealed must be circulated by the General Secretary to all concerned within thirty (30) days of their coming into effect.

21 . AMENDMENTS

Amendments to the Constitution of the Federation may be made at an General Body Meeting of the Federation called especially for the purpose. Any amendment of , addition to or abrogation of the Constitution shall need to be carried by a two-third majority of the members present and voting at the said meeting.
